India has put into effect the Madrid Protocol on July 08, 2013 and consequently amended the Trade Marks Act, 1999 and rules made thereunder.

The highlights are as below:

  • As on July 08, 2013, India put into effect the Madrid Protocol, simplifying international trade mark filing.
  • India acceded to the Madrid Protocol earlier this year and made the same effective beginning July 08, 2013.
  • The protocol simplifies the international procedure for registration of a trade mark.
  • An existing applicant or registered proprietor may now make an online application for registration of their trade mark under the Madrid Protocol.
  • A natural person or legal entity having real and effective industrial or commercial establishment in India, domiciled in India, or being a national of India may apply.
  • The applicant must have a registered trade mark or a pending trade mark application in India.
  • International registration in as many as 89 member countries, apart from India, can be obtained through a single application.
  • The application may be filed with the International Bureau of the WIPO in English.
  • A single set of fees is payable for the international filing process.
